When you use UserSignal to collect data from your end users, you act as the data controller and we act as the data processor. You are responsible for:
- Ensuring you have a valid legal basis to collect and process end user data.
- Providing appropriate privacy notices to your end users.
- Complying with all applicable data protection laws, including GDPR where applicable.
5. Payment and Billing
- Paid plans are billed monthly or annually in advance.
- All fees are non-refundable except as required by law.
- We may change pricing with 30 days' notice. Price changes do not apply to the current billing period.
- If payment fails, we may suspend access to paid features after a grace period.
6. Free Plan
The free plan is provided as-is with no guaranteed uptime or support level. We reserve the right to modify the free plan's feature set or usage limits at any time.
7. Cancellation
- You may cancel your account at any time from your dashboard settings.
- Upon cancellation, your data will be retained for 30 days in case you change your mind, after which it will be permanently deleted.
- We may terminate or suspend your account if you violate these Terms.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance when possible.
9. Intellectual Property
The Service, including its design, code, and branding, is owned by UserSignal and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
10. Limitation of Liability
To the maximum extent permitted by law, UserSignal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.
